GENERAL TERMS OF USE OF THE WEBSITE "www.b2b.sportdepot.bg"
The use of this site and the registration of an order through it shall be deemed as consent to the stated terms. If you DO NOT ACCEPT these terms, please do not use this website. Sport Depot SA reserves the right to change the terms at any time without prior notice, with the amended terms being published on the site.
I. General Terms
• “"www.b2b.sportdepot.bg"” is an e-commerce website – for the sale and delivery of the goods published on it, on behalf of Sport Depot SA.
• The publication on this site constitutes a public invitation to enter into a commercial transaction for the online purchase of items from Sport Depot SA.
• Sport Depot SA, via “"www.b2b.sportdepot.bg"”, has the right to change the prices of the offered goods at its own discretion without prior notice. The user is obliged to pay the price that was valid at the time of submitting the order for the desired goods. Notification of price reductions is made by placing the new price below the old one, with the latter being crossed out.
• Differences in prices of certain items offered on the site and in the Sport Depot store network are possible, due to local activities and discounts.
• If an incorrect or wrong address, contact person and/or phone number is provided when placing the order, Sport Depot SA via “"www.b2b.sportdepot.bg"” is not bound by any obligation to fulfill the order.
• The contract with the Client is considered concluded after acceptance by Sport Depot SA via “"www.b2b.sportdepot.bg"” of the purchase application correctly completed by the Client in the ordering process.
• Sport Depot SA via “"www.b2b.sportdepot.bg"” undertakes, after receiving an application from the Client, to deliver the requested goods or to inform the Client about other circumstances related to their order.
• Sport Depot SA is not responsible if the Client has provided incorrect and/or incomplete data in an order placed on “"www.b2b.sportdepot.bg"”.
• Sport Depot SA does not guarantee full correspondence between the items presented on the site and those available in the store network.
• Sport Depot SA is not responsible for any inaccuracies in the information published on the site. Price corrections in the stores are possible, as well as changes in product design.
• The information about sizes and conversions published on the site should be interpreted as indicative. Sport Depot SA allows for discrepancies between the announced and actual sizes, for which it is not liable.
• The categorization of items by purpose (the "Sport" filter) is indicative.
• All stated prices are in Bulgarian leva (BGN) including VAT.
II. Rights and Obligations of the Parties
1. Sport Depot SA undertakes to:
• confirm the availability of the ordered items or refuse the order within 7 business days;
• deliver, within the period indicated in the "delivery and payment information," the goods requested for purchase*.
*During the major seasonal SALES at SPORT DEPOT (January/February/up to March 15 and July/August/September, Black Friday) online orders have an extended delivery time. Online orders have an extended delivery time. The average delivery time during this period is up to 7 business days, and depending on workload and order volume, in some cases the delivery time may reach up to 14 days.
Due to the high order volume during these periods, it is possible that we may not be able to fulfill the delivery of all items ordered by a given client, and the client will be notified thereof. Delivery may also be made in parts; if the delivery does NOT meet the conditions for Free delivery, the client pays only the first fee, and the remaining deliveries are at the expense of Sport Depo. • have each item checked for technical soundness before shipping (if possible without compromising the integrity of the packaging);
• guarantee that all products are factory new (unused!) and sealed by the manufacturer, except in cases where the opposite is explicitly stated in the product presentation on the site.
2. The Client undertakes to:
• provide their full name, accurate and valid phone number, delivery address and email address;
• pay the price of the goods under the conditions described in the delivery and payment information;
• pay the delivery costs under the conditions described in the delivery and payment information;
• ensure access and the possibility to receive the goods.
The goods requested for purchase are delivered to the delivery address specified by the Client within the period indicated in the delivery and payment information.
The goods are delivered suitably packaged, according to their type and the delivery transport.
Upon delivery, the Client or a third party signs the accompanying documents. A third party is considered anyone who is not the holder of the application but accepts the goods upon delivery and is at the address specified by the client. During seasonal sales, the delivery may be made in parts.
If the Client is not found within the delivery period at the specified address or access and conditions for handing over the goods are not ensured within this period, Sport Depot SA is released from its obligation to deliver the requested goods for purchase. The Client may confirm their wish to receive the goods after the delivery term has expired, during which they were not found at the address, by assuming all delivery costs. In this case, a new delivery period starts from the moment of confirmation.
The Client has the right to refuse to receive the goods requested for purchase when they are delivered under any of the following conditions:
• the delivered goods clearly do not correspond to those requested for purchase by the Client and this can be established by their ordinary inspection.
• the price the Client is required to pay does not correspond to the due price.
• in case of a discrepancy between the requested and delivered goods that could not have been established at the moment of delivery.
In case of a discrepancy between the requested and delivered goods, the Client has the right to request an exchange of size or item included in their original order. In this case, it is necessary to submit the request, in writing (by email) or verbally (by phone), within no more than 14 days to the address Sofia 1766, 6 Vasil Radoslavov St., Business Park Sofia, Sport Depot Building, Sales Department.
The Client has the right, within no more than 14 days, without owing compensation or penalty and without stating a reason, to return the received items to the address Sofia 1766, 6 Vasil Radoslavov St., Business Park Sofia, Sport Depot Building, Sales Department.
Sport Depot refunds all amounts received from the consumer, including delivery costs.
The costs for returning the goods are borne by the client.
Returns are accepted under the following conditions:
• the return request has been submitted in writing to the email address for correspondence specified by Sport Depot SA, within no more than 14 days from the date the order was received. The request must include the client’s personal bank account to which the amount paid for the goods will be refunded;
• the goods are in good commercial condition, in their original packaging, with original labels, accompanied by the original documents issued by Sport Depot SA – invoice, receipt, warranty card (if such was issued);
• the client coordinates with a representative of Sport Depot SA the address to which Sport Depot SA wishes to receive the goods back;
• pursuant to the provisions of the Consumer Protection Act, Sport Depot refunds the amount paid by the client within 14 days from the date on which the client exercised their right to return the goods.
Sport Depot SA reserves the right not to refund the amount paid by the client in case one or more conditions for returning goods have been breached.
Refunds of amounts paid by cash on delivery.
For refunds of amounts paid by cash on delivery, there must be identity between the person who ordered the goods and the person returning the goods, regardless of who received them. Specifically, the person who ordered and returns the goods will receive back the money paid by cash on delivery. If the person who ordered is a child, the money is refunded to the child’s account or to their legal representative’s account – mother, father, or guardian. A Birth Certificate or a Guardianship Appointment Decision must be presented for this purpose.
III. Personal Data
Sport Depot SA respects the privacy of its customers and ensures, to the greatest extent possible, the protection of their personal data. Read the Privacy and Personal Data Protection Policy published here. It is prepared on the basis of current Bulgarian and European legislation in the field of personal data protection.
• Sport Depot SA, via “"www.b2b.sportdepot.bg"”, exercises due care for the protection of the Client’s personal data made known when completing the electronic form for submitting a registration application on the website and purchase. This obligation lapses if the Client has provided incorrect data.
• In compliance with the applicable legislation, the clauses of these General Terms and the Privacy Policy, Sport Depot SA may use the Client’s personal data solely and only for the purposes for which it was provided.
IV. Disclosure of Information
• Sport Depot SA, via "www.b2b.sportdepot.bg", undertakes not to disclose any personal data about the Client to third parties – state authorities, commercial companies, natural persons and others, except in cases where:
• it has received the Client’s explicit written consent;
• the information is requested by state authorities or officials who, according to the applicable legislation, are authorized to request and collect such information;
• Sport Depot SA, via “"www.b2b.sportdepot.bg"”, is obliged to provide the information by virtue of law.
V. Liability
• Sport Depot SA, via “"www.b2b.sportdepot.bg"”, is not liable for failure to fulfill its obligations under this contract upon the occurrence of circumstances that Sport Depot SA, via “"www.b2b.sportdepot.bg"”, did not foresee and was not obliged to foresee – including, but not limited to, force majeure, fortuitous events, problems in the global Internet network and in the provision of services beyond the control of Sport Depot SA, via “"www.b2b.sportdepot.bg"”.
VI. Arbitration
All disputes between the parties shall be resolved in a spirit of understanding and good will. In the event that agreement is not reached, all unresolved disputes arising from or relating to the contract between the parties, including disputes arising from or relating to its interpretation, invalidity, performance or termination, as well as disputes for filling gaps in the contract or adapting it to newly arisen circumstances, shall be resolved by the competent court at the place of registration of Sport Depot SA in accordance with Bulgarian law.
VII. Warranty Terms:
1. Sport Depot SA provides its clients, for each purchased item with a warranty, a warranty card which specifies:
• the address and telephone number of the authorized service centers for the purchased equipment;
• the warranty terms of the respective service centers or manufacturers;
• the warranty period of the purchased goods;
2. Except for the obligations specifically set forth in this warranty, Sport Depot SA shall not be liable for direct, indirect, special, incidental, or consequential damages, whether based on contract, tort due to omission by an officer, or any other legal theory, and whether the possibility of such damages has been anticipated.
3. The warranty terms of the respective manufacturer or authorized service centers apply to all products. Only the original warranty cards with which the goods were received are valid at the service centers.
VIII. Warranty Limitations
The warranty is void in case of:
1. Damages caused by poor transportation, storage, or improper operation.
2. Attempted repair by the Client and/or another unauthorized person.
3. Use of low-quality and non-original consumable materials.
IX. Additional Terms:
1. Sport Depot SA is not liable for damage to the goods as a result of force majeure circumstances.
